Welcome to the Arheb application.
Please read these Terms and Conditions carefully before using the application or any of its services. Your use of the “Arheb” application, creation of an account, or placing of any order through it constitutes your explicit, final, and binding agreement to all the terms and conditions contained in this document, including any future amendments that may be made to them.
These Terms and Conditions apply to all users of the “Arheb” application, including customers, restaurants, stores, service providers, delivery captains, visitors, and commercial agents.
Important Note: If you do not agree to these Terms and Conditions, please immediately stop using the “Arheb” application.
Definitions

The “Arheb” Application: A smart electronic platform operating via mobile phones and smart devices, allowing users to order food, products, and various services from participating restaurants, stores, groceries, pharmacies, and service providers.

The User: Any natural or legal person who uses the “Arheb” application or creates an account on it.

The Merchant: Any restaurant, store, grocery, pharmacy, or service provider that displays its products or services through the “Arheb” application.

The Delivery Captain: Any person or entity that delivers orders to users through the “Arheb” application.

The Order: Any purchase process or request for a service or product made through the application.
-
The Child: Any user under the age of 18.
Nature of Arheb Platform Services
The Arheb platform allows its users to order from restaurants, stores, groceries, pharmacies, and service providers partnered with the application, whether owned or operated by independent third parties, affiliates, or entities contracted with “Arheb” (collectively referred to as “Merchants”).
The primary purpose of the “Arheb” application is to provide a seamless and convenient technical experience for users by connecting them with Merchants within their geographical scope to enable them to order and receive a variety of goods and services. This includes—but is not limited to—ready-made meals, beverages, food products, grocery items, legally permissible over-the-counter pharmaceuticals, and various consumer goods.
The “Arheb” platform provides an interactive electronic interface that enables the user to browse stores, select products, and submit orders electronically with ease.
When a user places an order through the application, “Arheb” acts solely as a technical and electronic mediator between the user and the merchant for the purpose of managing the order and improving the user experience. The user acknowledges and agrees that the “Arheb” application does not sell goods directly, nor does it interfere with their manufacturing, preparation, packaging, production, or presentation; its role is strictly limited to providing the electronic platform that connects the user to the merchant.
Terms of Application Use

The user commits to using the “Arheb” application solely for legal and legitimate purposes.

It is strictly prohibited to use the application for any illegal or fraudulent purpose, or any purpose that causes harm to the application or any third party.

The “Arheb” application reserves the right to modify or discontinue any service or part of the application at any time without prior notice.

The application reserves the right to reject any order, or suspend or cancel any account upon suspicion of any non-compliant or fraudulent activity.
Account Creation

The user must provide true, accurate, and up-to-date information upon registration.

The user bears full responsibility for maintaining the confidentiality of their login data.

The “Arheb” application has the right to suspend or delete any account that contains incorrect or misleading information.

Accounts may not be shared with any other person.

The user must be at least 18 years of age, or otherwise use the application under the supervision of a parent or legal guardian.
Orders and Payment

All orders are subject to the availability of products and services at the Merchant’s side.

Prices displayed within the “Arheb” application include the value of the products only, unless stated otherwise.

Delivery fees, taxes, or service charges may be added depending on the region or the Merchant.

The “Arheb” application reserves the right to modify prices and delivery fees at any time.

Available payment methods may include:

The user is responsible for verifying the accuracy of the order details before confirming it.
Delivery Policy

Delivery times depend on the geographical location, Merchant status, and traffic conditions.

Specified delivery times are estimates only and are not strictly binding.

The user is responsible for providing a clear, accurate address and a reachable phone number.

If the user fails to respond or cannot be reached, the delivery captain has the right to cancel the order after a reasonable waiting period.

Additional fees may apply if the delivery location is changed after the order has been confirmed.
Quality of Products and Services
The Merchant alone bears full responsibility for:

The quality of the products and services provided.

Food and product safety.
-
Compliance with health, sanitary, and regulatory requirements.

Compliance with applicable local laws.
-
The accuracy of product descriptions, prices, and ingredients.
-
Adherence to food allergy requirements or specific dietary restrictions of users.
Furthermore, the “Arheb” application does not independently verify:

The licenses or permits of Merchants.
-
The quality of products or their ingredients.
-
The accuracy of data or classifications displayed by the Merchant.
-
The extent of the Merchant’s compliance with applicable rules and regulations.
The user is responsible for reviewing product information and communicating directly with the Merchant if they have food allergies, health requirements, or inquiries regarding ingredients and allergens.
The “Arheb” application does not guarantee that products are free of allergens or suitable for any specific diet unless explicitly required by applicable laws. The user acknowledges that all product classifications, claims, or labels such as: Organic, Gluten-Free, Lactose-Free, Nut-Free, Diet, Healthy, or any similar descriptions, are provided solely by the Merchant, and the “Arheb” application bears no responsibility for their validity or accuracy.
Special Instructions for Orders
The Arheb platform and its partnered Merchants strive to accommodate special instructions and notes added by the user to the order; however, some requests or modifications may not be practically or commercially feasible.
Accordingly, the “Arheb” application and/or the Merchant reserve the right to fulfill the order in accordance with the Merchant’s standard operating procedures, without incurring any liability for failing to fully implement special instructions. Furthermore, neither the “Arheb” application nor the Merchant is obliged to replace or refund the value of any order due to its non-compliance with the special notes or instructions entered by the user.
Cancellation and Refund Policy

An order cannot be canceled after the Merchant has started preparing it, except in accordance with the Merchant’s approved policy.

In the event of an error in the order or non-receipt, the user can contact Customer Service.

The “Arheb” application reserves the right to evaluate refund or compensation requests on a case-by-case basis.

The “Arheb” application does not assume liability for the quality or safety of food or products, as this responsibility falls entirely on the providing Merchant.
User Obligations
The user acknowledges and pledges to:

Not misuse the “Arheb” application.

Not send or publish any content that violates the law or public decency.
-
Not attempt to hack the application or disrupt its systems.
-
Not use illicit payment methods.
-
Not exploit offers or coupons in a fraudulent manner.
-
Not use the application in a way that harms Merchants, other users, or the reputation of “Arheb”.
Intellectual Property
All rights related to the “Arheb” application, including:

The trade name and logos

Designs and software
-
Images, text, and databases
Are considered the exclusive property of the “Arheb” application and/or its owning company. It is strictly prohibited to copy, republish, sell, or exploit any part of the application without prior written consent.
Indemnification and Limitation of Liability
By using the Arheb application, the user agrees to indemnify, defend, and hold harmless the “Arheb” application, its owning company, affiliates, sister companies, owners, partners, directors, employees, agents, representatives, contractors, service providers, and delivery captains from any claims, lawsuits, liabilities, damages, losses, costs, expenses, legal fees, or attorney fees—whether direct, indirect, incidental, or consequential—arising out of or relating to:

The user’s use of the “Arheb” application.

Misuse of the application or services.

Violation of these Terms and Conditions.

Violation of any applicable law or regulation.

Infringement of intellectual property rights, privacy, or any rights of a third party.

Any content, information, or data published or sent by the user through the application.

Any dispute between the user and any Merchant, delivery captain, or third party.

Any act, omission, or conduct committed by the user while using the Arheb platform.
General Disclaimer
The user explicitly acknowledges and agrees that the use of the Arheb application is entirely at their own personal risk, and that all services, content, and functionalities available through the application are provided “as is” and “as available” without warranties of any kind, either express or implied.
The “Arheb” application makes no representations or warranties regarding:

The continuous, uninterrupted, or error-free operation of the application.

The absence of technical glitches, viruses, or programming bugs.

The accuracy, reliability, or completeness of information, prices, images, or descriptions displayed by Merchants.

The quality, safety, legality, or suitability of products or services.

The commitment of Merchants or delivery captains to any standards, instructions, or laws.

The compatibility of products with the user’s expectations, personal needs, or health requirements.

Product availability or the accuracy of the displayed inventory.
-
Delivery times or the guarantee against delays.
Furthermore, the “Arheb” application assumes no liability for:

Any health, dietary, or allergic adverse effects.

Any financial losses, commercial damage, loss of profits, or loss of data.

Any direct, indirect, incidental, or consequential damages.
-
Any actions, errors, or negligence committed by Merchants, delivery captains, or any third party.

Any interruption, suspension, or temporary/permanent cessation of service.
-
Any unauthorized use of the user’s account resulting from their negligence in protecting their login credentials.
Account Termination
The Arheb application reserves the right to suspend or terminate a user’s account without prior notice in the following scenarios:

Violation of these Terms and Conditions.

Misuse of the application.

Fraud or the use of illicit payment methods.
-
Actions causing harm to the reputation of the application, its employees, or its users.
Amendments
The “Arheb” application reserves the right to modify these Terms and Conditions at any time. Continued use of the application following the posting of amendments constitutes an implicit acceptance of the revised terms.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the state in which the “Arheb” application is registered and operated. The competent courts of that jurisdiction shall have exclusive authority over any dispute arising from them.
